Acceptance of Terms

By accessing and using HyTerm ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. These Terms of Use constitute a legally binding agreement between you and Yvan Ahinaga ("we," "us," or "our") regarding your use of the HyTerm bilingual terminology management platform.

Service Description

HyTerm is a crowd-sourced and AI-powered bilingual terminology management platform that provides English-French terminology lookup, context-specific term searches, professional terminology database access, AI-powered translation suggestions, intelligent language detection, context-aware recommendations, term addition and editing capabilities, bulk CSV upload functionality, collaborative terminology building, usage statistics and trends, database growth metrics, and community activity tracking. The service is provided without requiring user accounts or personal information.

User Responsibilities and Content Quality

When contributing terminology to HyTerm, you agree to provide accurate and verified translations, include appropriate context and source information when available, use professional and standardized terminology, and respect intellectual property rights. You are responsible for ensuring that any content you submit does not infringe upon the rights of third parties and that you have the right to contribute such terminology to our public database.

Public Access and Term Entry Agreement

By using this website and contributing term entries, you explicitly agree that: All term entries you create or contribute will be accessible publicly and for an unlimited amount of time by all website users. Your term entries become part of our public terminology database and may be viewed, used, and referenced by anyone accessing the HyTerm platform. Your term entries can be deleted at any time without prior notice by the site administrator for any reason, including but not limited to quality control, accuracy concerns, or policy violations. You waive any claim to individual ownership or control over term entries once they are submitted to the platform. Your contributions are made voluntarily for the benefit of the global language professional community.

Acceptable Use Policy

You may use HyTerm for professional translation and terminology work, educational and research purposes, contributing verified terminology, collaborative terminology development, and personal and commercial translation projects. You may not submit false or misleading information, attempt to disrupt or damage the service, violate intellectual property rights, engage in automated scraping or data harvesting, upload malicious content or code, or use the service for any illegal or unauthorized purposes. We reserve the right to investigate and take appropriate action against users who violate these terms.

Intellectual Property Rights

The HyTerm platform, including its design, functionality, software, and underlying technology, is owned by Yvan Ahinaga and protected by copyright, trademark, and other intellectual property laws. When you contribute terminology to HyTerm, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, modify, and use your contributions as part of our public database and to improve our AI and search algorithms. You represent and warrant that any content you submit does not infringe upon the intellectual property rights of any third party.

Service Availability and Modifications

We strive to maintain high availability but cannot guarantee uninterrupted service. Maintenance, updates, and unforeseen circumstances may cause temporary disruptions. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice, to improve functionality or address technical issues. The service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any terminology or translations provided through the platform.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, use, goodwill, or other intangible losses, damages resulting from errors in terminology or translations, unauthorized access to or alteration of data, or service interruptions or technical failures. In no event shall our total liability to you for all damages, losses, and causes of action exceed $100. While HyTerm is designed for professional use, users are responsible for verifying the accuracy and appropriateness of any terminology before use in professional, legal, medical, or other critical contexts.

Indemnification

You agree to defend, indemnify, and hold harmless HyTerm, Yvan Ahinaga, and our affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use or misuse of the service, your violation of these Terms of Use, your violation of any third-party rights including intellectual property rights, any content you submit to the platform, or any harm caused to third parties through your use of the service.

Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. We encourage resolving disputes through direct communication. For formal disputes, both parties agree to attempt mediation before pursuing litigation. Any legal action or proceeding arising under these terms will be brought exclusively in courts of competent jurisdiction, and the parties consent to personal jurisdiction in such courts.

Termination

You may stop using our service at any time. We may suspend or terminate your access for violations of these terms, illegal activity, or other reasons at our discretion. Upon termination, your right to use the service ceases immediately. However, terminology you contributed may remain in our database to serve the community, as outlined in our intellectual property section and public access agreement.

Changes to These Terms

We reserve the right to modify these Terms of Use at any time to reflect changes in our services, legal requirements, or business practices. We will provide prominent notice on our website for significant changes, email notification for material changes affecting user rights (where contact information is available), update the "Last modified" date at the top of these terms, and provide a 30-day notice period for major changes. Your continued use of HyTerm after any changes indicates your acceptance of the updated Terms of Use.
